  • We present a mitigation packet to the judge and district attorney that explains who you are as a person, outside of your arrest or allegation, so you are not seen as just another case number
  • Moving to exclude any evidence that was obtained in violation of your rights
  • Challenging the sufficiency of the prosecution’s case by filing a motion to reduce or dismiss your charges
  • Negotiating a plea agreement with the prosecution if it has a strong case to help you avoid the most severe consequences of a conviction

Our Firm Advocates on Behalf of People Facing All Types of Criminal Cases

At Lamano Law Office, our Contra Costa criminal defense attorneys work hard on behalf of our clients. Some of the most common charges that our clients face include:

  • Assault and battery – Assault and battery crimes involve offenses wherein a person injures someone or places someone in fear of imminent injury due to force or the threat of force.
  • Child abuse charges – Child abuse charges may be filed when someone inflicts physical or mental injury on a child through physical or sexual violence, by placing a child at risk of injury, or by neglecting a child when one has a legal duty to care for the child’s health and well-being.
  • Domestic violence – Domestic violence involves any act of physical violence, threat of violence, or harassment committed against someone whom the perpetrator has a current or former intimate relationship with, such as a spouse, fiancé, dating or sexual partner, or co-parent.
  • Drug offenses – Examples of drug offenses include possession of narcotics, distribution of drugs, manufacturing, and trafficking.
  • DUI defense – We represent clients in all kinds of DUI cases, including driving with a BAC of .08 percent or greater, driving under the influence of drugs, underage DUI, second and subsequent DUI offenses, and felony DUI.
  • Expungements – Under California law, certain criminal convictions are eligible to be expunged, which means that the conviction is sealed by the court. After obtaining an expungement, you can, in most circumstances, legally deny that you were ever convicted of the underlying offense.
  • Felony charges – Felonies include the most serious criminal offenses governed by California and federal law, with convictions typically resulting in sentences of a year or more in prison.
  • Gun charges – We can assist you with all varieties of firearms offenses, including unlawful possession of a weapon, possession or use of a weapon for unlawful purposes, and possession of firearms by a felon or other person not permitted to possess a firearm.
  • Disorderly/lewd conduct – Disorderly or lewd conduct crimes occur when someone engages in offensive, disruptive, or sexual behavior in public or in view of the public, typically in such a way as to disrupt others’ enjoyment of public spaces.
  • Military diversion – In California, military veterans and active-duty personnel may have the option of seeking treatment for a mental health issue or substance abuse problem caused by or related to their military service. This option is offered as an alternative to being convicted and sentenced on a criminal charge connected to their mental health or substance abuse issue.
  • Misdemeanor charges – Misdemeanors are less serious crimes than felonies, with convictions resulting in sentences that involve up to 364 days imprisonment or, in many cases, a term of probation, community service, or fines and restitution.
  • Probation violations – Violating any condition of your probation can result in consequences, such as an extension of your probation term, the imposition of additional conditions, or the revocation of probation and sentencing on your original conviction.
  • Property crimes – Common property crimes include trespassing, vandalism, and criminal destruction of property.
  • Restraining orders – Restraining orders and orders of protection are issued to safeguard an individual from future violence, threat of violence, or harassment.
  • Sex offenses – Common sex offenses include rape, sexual battery, statutory rape, lewd conduct, oral copulation with a child, and child pornography crimes.

Penalties for a Criminal Conviction in Contra Costa

Penalties for a criminal conviction in Contra Costa County vary depending on the grading of the charge. Crimes prosecuted under California state law are broadly categorized either as misdemeanors or felonies. Some misdemeanors are known as “wobblers,” because they can also be charged as felonies under certain circumstances.

Misdemeanors are comprised of less-serious criminal offenses governed by California law. Maximum penalties for a misdemeanor conviction include:

  • Standard misdemeanor: Up to six months in jail and/or a fine of up to $1,000
  • Aggravated misdemeanor: Up to 364 days in jail and/or a fine of up to $1,000

Felonies are the more serious criminal offenses in California. Penalties for a felony conviction can include:

  • Imprisonment of one year or more
  • Fines, typically as high as $10,000
  • Other terms such as loss of your rights to possess a firearm, registration as a sexual offender, community service, restitution, and participation in behavior or substance abuse treatment programs

In California, most felony statutes specify the prison sentences that can be imposed for a conviction under that statute. The statutes usually list a low term, middle term, and high term. If the court chooses to mandate incarceration as part of a sentence, it will choose one of these terms to impose based on factors such as the defendant’s age, criminal history, and the nature of the crime in question.

Courts also retain the discretion to convert a portion of or all a term of incarceration into a term of either informal or formal probation. Individuals on probation are required to follow all conditions of their probation. Violating probation may result in the probation term being extended, the imposition of additional conditions of probation, or the revocation of probation and the imposition of a sentence under the original conviction.

In addition to a sentence, a criminal conviction can also have long-term consequences, such as:

  • A criminal record that can make it difficult to successfully apply for housing, employment, educational opportunities, and professional licensure
  • If convicted of a felony, loss of the right to serve on juries or to own or possess firearms
  • If convicted of a sex offense, the requirement to register as a sex offender

Fortunately, in certain circumstances, you may be entitled to obtain relief from the stigma of a criminal conviction. Talk to our Contra Costa criminal defense attorneys to learn more about your post-conviction options.
